U.S. Customs sealUS Federal agents may take a traveler's electronic devices, such laptop computers or cell phones to an off-site location for an unspecified period of time without any suspicion of wrongdoing.

Also may share copies of the laptop's contents with other agencies and private entities for language translation, data decryption or other reasons, according to the policy regarding border search of information, dated July 16 and issued by two DHS agencies, U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.


In the other hand, in US Constitution, Amendment IV:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Which one should prevail?

Personal note: I think this could hurt heavily business travels to US. Due to economic crises, many companies already have put a stop to air travel unless it is neccesary. So, it is not easy to reach a conclusion.

The right for US Federal Agents/Homeland Security to seize information containing electronics such as laptops, mobile phones, cameras etc. at US borders is now for public knowledge but seems to have been going on for a few years now. It is only recently that most people are now aware of the possibility.

Although the 4th Amendment protects against unreasonable searches and seizures, border crossing are or seem to be exempt from this. Profiling against Muslim, Middle Eastern and South Asian decent seem to be more of the target, but no one is excluded from this possibility. Terrorist and child pornography is what they claim they are after. This is just the on going process of the United States to continue its quest to strip anyone entering the country of any rights. These types of things cannot be seized in ones home without court approval and search warrants so this is the easiest way to obtain information without having to go through the legal process

So when entering the US take your shoes off, be prepared for a full body search and having someone rummage through your bags and finally, be prepared to have your electronics confiscated. I am sure business travel is down and companies are finding new ways to conduct business with less risk, but personal travel is also in jeopardy and as more travelers become aware of this possibility.

The US Gov't has so many people brainwashed into thinking terrorism is all around and lurking at every corner, and propaganda continues to be fed to the citizens, Homeland Security has gone beyond the limits than what most Americans are aware of. This effects not only foreigners traveling to the US but US citizens returning. Land of the Free??!!
